Fora App Terms of Use
1. Parties and Scope
These Terms of Use (hereinafter referred to as Terms) have been set between Forinvest Yazılım ve Teknoloji Hizmetleri Anonim Şirketi (hereinafter referred to as Fora) and the persons (User) who are members of the Website https://www.gofora.com/ and Fora Mobile Applications (hereinafter collectively referred to as the Site) in order to define their rights and obligations regarding the services provided by Fora.2. | Partner Organizations | refers to the organizations that collaborate with Fora through integration to provide Services to the Website and/or Mobile Application Users and are engaged in the trading of crypto assets, precious metals, and other assets. |
| Website | refers to Fora's Website consisting of the domain name https://www.gofora.com/ or subdomains connected to this domain name. |
| Mobile Application and web platform | refers to the web platform accessible via the domain name https://www.gofora.com/ and Mobile Applications published by Fora in the application markets. It covers the Service allowing Users to transact through their accounts at third-party organizations, whether integrated or separate. |
| Package / Data Pack | refers to the data sharing Service sourced from third parties that Fora provides to its Users. |
| Service / Services | refers to all kinds of Services such as content, news, information, data broadcasting which are offered to Users through the Website or application. |
3. Use of Mobile Application and Website
1. Fora provides the User with the right to benefit from content such as news, data, analysis and to transact within the framework of the Services provided by the relevant third-party organizations through the Mobile Application and web platform. By using the Mobile Application and web platform, the User is deemed to have accepted these Terms of Use. 2. The User agrees and undertakes to share all information and documents requested from them while creating an account on the Mobile Application and web platform with Fora in a complete, accurate and non-misleading manner. 3. Users must be over 18 years of age. The User hereby accepts, declares and undertakes that they are over 18 years of age within the scope of this Agreement and that they have the capacity of right and action within the scope of the Turkish Civil Code and that he/she is not under the influence of any restriction, guardianship or permanent deprivation of the power of discernment. 4. The User agrees and undertakes to use the Mobile Application and web platform in accordance with all applicable laws and provisions, including, but not limited to, Law No. 5846 of Intellectual Property Rights. 5. The User cannot transfer or sell their Mobile Application and web platform account and rights to third parties or allow anyone else to use their membership in any way. The User cannot make transactions in the Mobile Application and web platform for the benefit of another member or non-members and cannot open multiple accounts. 6. The Mobile Application and web platform, the Website, its domain name and all software, design and copyrights along with all their intellectual and industrial property rights belong entirely and exclusively to Fora. Processing, copying, reproduction and dissemination, as well as reverse engineering of any part of these Terms of Use are not permitted in any way. 7. Fora reserves the right to close User accounts without notice and/or suspend them until suspicious situations are clarified if it determines or suspects that the User has violated these Terms of Use or any applicable contract provision or law, or has engaged in malicious, manipulative transactions. 8. Notices and Notifications regarding situations arising from the implementation of this Agreement or future situations of this regard will be made to the email address provided by the User to Fora. 9. The User is obliged to keep his/her contact information up to date so that he/she can be reached when necessary. Otherwise, Fora is not liable for any situation that may occur.Sharing of Personal Data
1. The User may purchase Data Packages within the conditions set by Borsa Istanbul. Fora may offer Data Packages with single or multiple features to Users and may change the content and prices of these Packages according to market conditions. 2. Users purchase Data Packages by providing explicit consent. Users shall pay for the Data Packages in advance for the applicable period. 3. Payment can be made by credit card, bank transfer, payment service or by topping up the balance into the wallet created within the application. Fora reserves the right to change or completely remove payment methods. 4. Turkish lira balance transfers made via credit card or ATM will not be accepted. Such transfers will be refunded to the sender's account or card within five business days after deducting bank commissions. 5. When making Turkish lira transfers, Users are required to fill in information such as the recipient's title and description as specified by Fora. Fora will not be responsible for transfers not made in accordance with the information shared. 6. Fora may set minimum and maximum balance deposit and withdrawal limits at its sole discretion. Fora reserves the right to make changes in these limit amounts. Fora may set deposit and withdrawal limits specific to certain Users.3. Mobile Application and Web Platform Account Linking Procedures
1. Fora enables Users to access their account at third party organizations through the Mobile Application and web platform. 2. This access point is solely for accessing the account at the relevant intermediary organization and Fora is not responsible for the Username, account name or number, password, data content, data security, or any information and data provided or displayed by third-party institutions, such as order type and content or account balance. 3. The User transacts through the Mobile Application and the web platform at sole responsibility on their part and with the relevant third-party organization as the addressee. Transactions made by the User through the Mobile Application and web platform are entirely subject to the contractual relationship established with the relevant third-party organization. 4. Fora provides Users access to account opening, wallet opening, deposit and withdrawal or asset trading transactions at Partner Organizations through the trading module within the Mobile Application and web platform. 5. The User receives Services from the Partner Organization indicated for the relevant asset type in the Trading module. Transactions made by the User through the Trading module are entirely subject to the contractual relationship established with the relevant third-party organization. 6. The Partner Organization worked with for the relevant asset type and its information are clearly shown in the trading platform. 7. Orders, transactions, custody, and portfolio transactions related to asset trading are entirely under the authority and responsibility of the relevant Partner Organization.4. Remuneration
1. Fora may charge for Services such as Data Package streaming or use of the application on a tiered or single price basis. Pricing is published on the Website and Mobile Application. 2. Fora reserves the right to make changes on these prices and price tiers announced on the Fora Website and Mobile Application. 3. Fora will not charge any fees for transactions at third party organizations, carried out through the Mobile Application and web platform, and related fees, if any, will be paid to the third party organization or Partner Organization.5. Limitation of Liability
1. Fora cannot be held responsible in any way for technical malfunctions that may occur in the Mobile Application and web platform without its fault. Fora has no legal or criminal liability for any damages and losses arising or may arise from these malfunctions. 2. Fora has no legal or criminal liability for any damages and losses arising from the User's false declaration of information or documents while registering as a member of the Platform. 3. The User is personally responsible for the protection of their access information and password for their account on the Platform and not sharing them with others. The User is obliged to ensure the security of their account. Fora does not accept any responsibility if the User fails to ensure the security of these accounts or if the account information is shared. 4. Fora has no legal or criminal liability for the failure to reflect funds into the User's account resulting from money transfers that are not conducted in accordance with these terms of use. 5. News, tax and technical analysis information published by Fora does not constitute investment advice, portfolio management or guidance in any way. Fora cannot be held responsible for this information published on the platform. 6. Fora has no legal and criminal liability for any damages and losses arising or may arise from the User’s mistakes while performing transactions on the Fora Website.,6. Personal Data Protection and Privacy
1. The Parties shall act in accordance with Law No. 6698 on the Protection of Personal Data, the regulations and communiqués issued based on the Law and the decisions of the Personal Data Protection Board. 2. Fora keeps and records traffic data of the Website in accordance with Law No. 5651. Fora may use these records to identify Users, ensure system and User account security, combat fraud and comply with legal obligations. 3. Fora hereby accepts and undertakes to keep the personal information provided by the User as a member strictly confidential, to keep it secret and to take all necessary measures to protect personal information and showing the utmost care. The methods to be used to ensure confidentiality are at Fora's discretion. 4. In the event that User information is requested from Fora within the scope of an investigation or prosecution carried out by the competent authorities of the Republic of Türkiye within the scope of the Laws and Presidential Decrees, especially the Law No. 5549 on the Prevention of Laundering Proceeds of Crime and related regulations and other legislation, or with administrative requests, Fora is authorized to share this information with the relevant authorities. This does not constitute a breach of the confidentiality obligation.7. Applicable Law and Jurisdiction
In case of disputes arising from the use of the Mobile Application and web platform and the transactions made, these Terms of Use and Turkish Law shall apply, and the courts of Istanbul shall have jurisdiction.8. Enforcement and Amendments
These Terms of Use shall enter into effect upon the electronic approval by the User during membership registration process to the Mobile Application and web platform. The Terms of Use may unilaterally be amended by Fora; amendments shall take effect upon the notification to the e-mail addresses declared by the Users during registration.
